1. Why is succession planning important?

It isn’t always possible to predict a change in fortunes, so it’s important to plan for periods of ill-health, particularly when this could have a critical impact on the management of your business.

Having a succession plan in place for your business assets is key for three reasons:

1. continuity for your business – to ensure the business can seamlessly continue trading, protecting the interests of your beneficiaries and the livelihoods of your employees;

2. tax efficiency – certain business assets can qualify for full or partial exemption from IHT – it is important that your holdings are structured properly to ensure you qualify for all the reliefs available;

3. appointing the right people to administer your business – these can be different to the ones you choose for your personal estate.

What’s involved?

A business will and succession planning strategy can typically include:

– a Will
– a review (often in conjunction with your accountant and financial adviser) of any existing corporate documents including the company constitution, partnership agreement or shareholders agreement or sale/purchase agreement to make sure your succession plan and your Will work together – this is vital;
– a Lasting Power of Attorney giving someone the legal authority to make decisions on your behalf
– IHT planning
– a review of your asset-holding structures (e.g. Family Investment Companies) to make sure they work with your Will and that they are the most appropriate vehicle for your particular circumstances.

Client Onboarding

We recognise that this is often a pain point for our clients – the process of checking identity for anti money laundering purposes as well as just engaging with a firm of solicitors is often far more cumbersome than it needs to be.

We have streamlined this process massively to the benefit of our clients.

Our onboarding partner, Legl, will work with our clients to digitally conduct all checks that are required within days of sending out the onboarding link. Through this process, our client will be cleared both for anti money laundering and identity checking but also will be able to formally engage Arch Law Limited as their solicitors through electronic signature. This process with Legl is also applied to identifying source of funds later in the transaction when the client is looking to complete.

In order to ensure the best experience for our clients, we also use DocuSign to ensure digital execution of all relevant documents.

He specialises in tax and structuring advice for HNW and UHNW individuals and their families, including international asset-holding structures such as offshore trusts, PTCs and FICs, tax-efficient investing, inheritance and succession planning, and philanthropy. Jamie’s work often has an international element, particularly in relation to non-domiciled individuals and UK residents with cross-border requirements, and he regularly advises trustees, private banks and family offices on wealth management issues.
